{"id":135,"date":"2020-09-20T19:39:23","date_gmt":"2020-09-20T16:39:23","guid":{"rendered":"https:\/\/esmeraylaw.com\/tr\/?p=135"},"modified":"2021-02-21T00:14:11","modified_gmt":"2021-02-20T21:14:11","slug":"kira-artisinda-tufe-ust-sinir","status":"publish","type":"post","link":"https:\/\/esmeraylaw.com\/tr\/kira-artisinda-tufe-ust-sinir\/","title":{"rendered":"Kira Art\u0131\u015f\u0131nda T\u00dcFE \u00dcst S\u0131n\u0131r"},"content":{"rendered":"<p>[vc_row][vc_column][vc_column_text]<strong>Kira art\u0131\u015flar\u0131nda eski hal: <\/strong><\/p>\n<p style=\"text-align: justify;\">11\/01\/2011 tarihinde kabul edilerek y\u00fcr\u00fcrl\u00fc\u011fe giren 6098 say\u0131l\u0131 T\u00fcrk Bor\u00e7lar Kanunu\u2019nun kira s\u00f6zle\u015fmelerini d\u00fczenleyen b\u00f6l\u00fcm\u00fcn\u00fcn 343. maddesinde \u201cKonut ve \u00c7at\u0131l\u0131 \u0130\u015fyeri Kiralar\u0131\u201d ile ilgili olarak kira s\u00f6zle\u015fmelerinde kira bedelinin belirlenmesi d\u0131\u015f\u0131nda, kirac\u0131 aleyhine de\u011fi\u015fiklik yap\u0131lamayaca\u011f\u0131, devam eden 344. maddesinde de eski haliyle, taraflar\u0131n yenilenen kira d\u00f6nemlerinde uygulanacak kira bedeline ili\u015fkin anla\u015fmalar\u0131n\u0131n, bir \u00f6nceki kira y\u0131l\u0131nda \u00fcretici fiyat endeksindeki art\u0131\u015f oran\u0131n\u0131 ge\u00e7memek ko\u015fuluyla ge\u00e7erli olaca\u011f\u0131 h\u00fckm\u00fc bulunmaktayd\u0131. Taraflarca bu konuda bir anla\u015fman\u0131n yap\u0131lmam\u0131\u015f olmas\u0131 durumunda ise, yeni kira y\u0131l\u0131 i\u00e7in ge\u00e7erli olacak kira bedelinin, bir \u00f6nceki kira y\u0131l\u0131n\u0131n \u00fcretici fiyat endeksindeki art\u0131\u015f oran\u0131n\u0131 ge\u00e7memek ko\u015fuluyla h\u00e2kim taraf\u0131ndan, kiralanan\u0131n durumu g\u00f6z \u00f6n\u00fcne al\u0131narak hakkaniyete g\u00f6re belirlenece\u011fi h\u00fck\u00fcm alt\u0131na al\u0131nm\u0131\u015ft\u0131.<\/p>\n<p style=\"text-align: justify;\"><strong>Benimsenen \u00dcFE oran\u0131 esas\u0131 uygulamada anla\u015fmazl\u0131klara yol a\u00e7m\u0131\u015ft\u0131r.<\/strong><\/p>\n<p style=\"text-align: justify;\">Eski hali ile Kanun maddesi uygulamada yenilenen kira d\u00f6nemi i\u00e7in kira art\u0131\u015f oran\u0131n\u0131n net ve kesin olarak belirlenebilmesini m\u00fcmk\u00fcn k\u0131lmad\u0131\u011f\u0131ndan s\u0131k s\u0131k kirac\u0131 ve kiraya veren aras\u0131nda anla\u015fmazl\u0131klar ya\u015fanmas\u0131na sebep olmaktayd\u0131. Bor\u00e7lar Kanunu\u2019nun y\u00fcr\u00fcrl\u00fc\u011fe girdi\u011fi 2011 y\u0131l\u0131ndan evvel, T\u00dc\u0130K taraf\u0131ndan yurt i\u00e7inde \u00fcretici kesimde, toptanc\u0131 kesimde fiyat de\u011fi\u015fim oranlar\u0131 Toptan E\u015fya Fiyatlar\u0131 Endeksi (TEFE) olarak yay\u0131nlanmaktayd\u0131. Kanun yay\u0131nland\u0131\u011f\u0131 tarihte ise, TEFE art\u0131k gitmi\u015f yerine \u00dcretici Fiyatlar\u0131 Endeksi (\u00dcFE) gelmi\u015fti. Bu nedenle, \u00fcretici kesimdeki fiyat art\u0131\u015f oran\u0131 Kanun\u2019a \u00dcFE olarak girmi\u015fti. Ancak, Bor\u00e7lar Kanunu\u2019nun yay\u0131nlanmas\u0131ndan \u00fc\u00e7 y\u0131l sonra 2014 y\u0131l\u0131nda \u00dcFE endeksi de terkedildi ve yerine Yurt \u0130\u00e7i \u00dcretici Fiyat Endeksi (Y\u0130-\u00dcFE), Yurt D\u0131\u015f\u0131 \u00dcretici Fiyat Endeksi (YD-\u00dcFE), Tar\u0131m \u00dcr\u00fcnleri \u00dcretici Fiyat Endeksi (Tar\u0131m \u00dcFE) olmak \u00fczere \u00fc\u00e7 ayr\u0131 endeks kabul edildi. Endeks de\u011fi\u015fikli\u011fi ise Bor\u00e7lar Kanunu\u2019nun kira yenilemelerinde kira art\u0131\u015f oran\u0131n\u0131n \u00fcst s\u0131n\u0131r\u0131n\u0131 tayin eden 344. maddesine yans\u0131t\u0131lmam\u0131\u015ft\u0131. Kanun maddesinde kira art\u0131\u015f oran\u0131n\u0131n \u00fcst s\u0131n\u0131r\u0131n\u0131n \u00dcFE oldu\u011fu belirtilirken, bunun uygulamada kar\u015f\u0131l\u0131\u011f\u0131n\u0131n hangi oran olaca\u011f\u0131 belirsizli\u011fini korumaktayd\u0131. Kirac\u0131 bu \u00fc\u00e7 orandan en d\u00fc\u015f\u00fck olan\u0131na g\u00f6re, kiraya veren ise en y\u00fcksek olan\u0131na g\u00f6re kiraya art\u0131\u015f yap\u0131lmas\u0131n\u0131 istemekte ve bu da taraflar aras\u0131nda anla\u015fmazl\u0131\u011fa sebep olmaktayd\u0131. \u00d6zellikle, Ocak ay\u0131 ba\u015f\u0131nda T\u00dc\u0130K taraf\u0131ndan 2018 y\u0131l\u0131 12 ayl\u0131k Y\u0130-\u00dcFE ortalamas\u0131n\u0131n 27,01 olarak a\u00e7\u0131klanmas\u0131 \u00fczerine, Bor\u00e7lar Kanunu\u2019na g\u00f6re standart olarak d\u00fczenlenmi\u015f ve kira art\u0131\u015f\u0131n\u0131n \u00dcFE\u2019ye g\u00f6re yap\u0131laca\u011f\u0131na ili\u015fkin h\u00fck\u00fcm i\u00e7eren kira s\u00f6zle\u015fmelerinde, kirac\u0131lar\u0131n ma\u011fdur olmas\u0131n\u0131n \u00f6n\u00fcne ge\u00e7ilmesi maksad\u0131yla Bor\u00e7lar Kanunu\u2019ndaki 344. Madde ile ilgili d\u00fczenlemeye gidilmi\u015ftir.<\/p>\n<p style=\"text-align: justify;\"><strong>17\/01\/2019 tarihli torba yasa ile Bor\u00e7lar Kanunu\u2019nda yap\u0131lan d\u00fczenleme<\/strong><\/p>\n<p style=\"text-align: justify;\">18 Ocak 2019 tarihli resmi gazetede yay\u0131nlanarak y\u00fcr\u00fcrl\u00fc\u011fe giren 17\/01\/2019 tarih 7161 say\u0131l\u0131 Vergi Kanunlar\u0131 \u0130le Baz\u0131 Kanun Ve Kanun H\u00fckm\u00fcnde Kararnamelerde De\u011fi\u015fiklik Yap\u0131lmas\u0131na Dair Kanun ile Bor\u00e7lar Kanunu\u2019nun 344. Maddesi de de\u011fi\u015ftirilmi\u015ftir.<\/p>\n<p style=\"text-align: justify;\">56. maddesi ile s\u00f6z konusu Kanun, kira art\u0131\u015f oran\u0131 a\u00e7\u0131s\u0131ndan hem bir yenilik getirmi\u015f hem de a\u00e7\u0131klama yapm\u0131\u015ft\u0131r. Bu maddeye g\u00f6re yeni kira y\u0131l\u0131nda kira art\u0131\u015f\u0131 \u00dcFE art\u0131\u015f oran\u0131na g\u00f6re de\u011fil, T\u00dcFE art\u0131\u015f oran\u0131na g\u00f6re belirlenecektir. Ayr\u0131ca T\u00dcFE oran\u0131 da d\u00f6rt ayr\u0131 esasa g\u00f6re belirlendi\u011finden buna da a\u00e7\u0131kl\u0131k getirilmi\u015ftir. Buna g\u00f6re kira art\u0131\u015f\u0131 T\u00dcFE 12 ayl\u0131k ortalamaya g\u00f6re belirlenecektir. 344. Maddede yap\u0131lan de\u011fi\u015fiklik ile 2018 y\u0131l\u0131 \u00dcFE ve T\u00dcFE 12 ayl\u0131k ortalamalar\u0131 da g\u00f6z\u00f6n\u00fcnde tutuldu\u011funda, yeni kira d\u00f6nemleri i\u00e7in ge\u00e7erli olacak kira art\u0131\u015flar\u0131nda \u00fcst s\u0131n\u0131r yar\u0131ya yak\u0131n oranda a\u015fa\u011f\u0131 \u00e7ekilmi\u015f oldu. T\u00dc\u0130K verilerine g\u00f6re, T\u00fcrkiye\u2019nin %43\u2019\u00fcn\u00fcn kirac\u0131 oldu\u011fu ger\u00e7e\u011fi de dikkate ald\u0131\u011f\u0131nda, getirilen de\u011fi\u015fiklik olduk\u00e7a geni\u015f bir kitleyi ilgilendiriyor.<\/p>\n<p style=\"text-align: justify;\">Son de\u011fi\u015fiklikler ile birlikte 344. Madde \u015f\u00f6yle olmu\u015ftur:<\/p>\n<p style=\"text-align: justify;\">\u201cMADDE 344 \u2013 <em>Taraflar\u0131n yenilenen kira d\u00f6nemlerinde uygulanacak kira bedeline ili\u015fkin anla\u015fmalar\u0131, bir \u00f6nceki kira y\u0131l\u0131nda t\u00fcketici fiyat endeksindeki oniki ayl\u0131k ortalamalara g\u00f6re de\u011fi\u015fim oran\u0131n\u0131 ge\u00e7memek ko\u015fuluyla ge\u00e7erlidir. Bu kural, bir y\u0131ldan daha uzun s\u00fcreli kira s\u00f6zle\u015fmelerinde de uygulan\u0131r.<\/em><\/p>\n<p style=\"text-align: justify;\"><em>Taraflarca bu konuda bir anla\u015fma yap\u0131lmam\u0131\u015fsa, kira bedeli, bir \u00f6nceki kira y\u0131l\u0131n\u0131n t\u00fcketici fiyat endeksindeki oniki ayl\u0131k ortalamalara g\u00f6re de\u011fi\u015fim oran\u0131n\u0131 ge\u00e7memek ko\u015fuluyla h\u00e2kim taraf\u0131ndan, kiralanan\u0131n durumu g\u00f6z \u00f6n\u00fcne al\u0131narak hakkaniyete g\u00f6re belirlenir. <\/em><\/p>\n<p style=\"text-align: justify;\"><em>Taraflarca bu konuda bir anla\u015fma yap\u0131l\u0131p yap\u0131lmad\u0131\u011f\u0131na bak\u0131lmaks\u0131z\u0131n, be\u015f y\u0131ldan uzun s\u00fcreli veya be\u015f y\u0131ldan sonra yenilenen kira s\u00f6zle\u015fmelerinde ve bundan sonraki her be\u015f y\u0131l\u0131n sonunda, yeni kira y\u0131l\u0131nda uygulanacak kira bedeli, h\u00e2kim taraf\u0131ndan t\u00fcketici fiyat endeksindeki oniki ayl\u0131k ortalamalara g\u00f6re de\u011fi\u015fim oran\u0131, kiralanan\u0131n durumu ve emsal kira bedelleri g\u00f6z \u00f6n\u00fcnde tutularak hakkaniyete uygun bi\u00e7imde belirlenir.<\/em><\/p>\n<p style=\"text-align: justify;\"><em>Her be\u015f y\u0131ldan sonraki kira y\u0131l\u0131nda bu bi\u00e7imde belirlenen kira bedeli, \u00f6nceki f\u0131kralarda yer alan ilkelere g\u00f6re de\u011fi\u015ftirilebilir.<\/em><\/p>\n<p style=\"text-align: justify;\"><em>S\u00f6zle\u015fmede kira bedeli yabanc\u0131 para olarak kararla\u015ft\u0131r\u0131lm\u0131\u015fsa 20\/2\/1930 tarihli ve 1567 say\u0131l\u0131 T\u00fcrk Paras\u0131n\u0131n K\u0131ymetini Koruma Hakk\u0131nda Kanun h\u00fck\u00fcmleri sakl\u0131 kalmak \u015fart\u0131yla, be\u015f y\u0131l ge\u00e7medik\u00e7e kira bedelinde de\u011fi\u015fiklik yap\u0131lamaz. Ancak, bu Kanunun, \u201cA\u015f\u0131r\u0131 ifa g\u00fc\u00e7l\u00fc\u011f\u00fc\u201d ba\u015fl\u0131kl\u0131 138 inci maddesi h\u00fckm\u00fc sakl\u0131d\u0131r.
