Hukuk Dairesince bozulmas\u0131 \u00fczerine, verilen direnme karar\u0131na ili\u015fkin dava dosyas\u0131 02.12.2016 tarihinde y\u00fcr\u00fcrl\u00fc\u011fe giren 6763 say\u0131l\u0131 Kanun&#8217;un 45. maddesi ile 6100 say\u0131l\u0131 HMK&#8217;na eklenen ge\u00e7ici 4\/1. maddesi uyar\u0131nca Yarg\u0131tay Hukuk Genel Kurulu taraf\u0131ndan Dairemize g\u00f6nderilmi\u015f olmakla, dosyadaki ka\u011f\u0131tlar okunup gere\u011fi d\u00fc\u015f\u00fcn\u00fcld\u00fc:<br \/>\nYerel mahkeme karar\u0131n\u0131n daval\u0131 taraf\u0131ndan temyizi \u00fczerine, Yarg\u0131tay 6. Hukuk Dairesince 01\/12\/2014 g\u00fcn, 2014\/2608 Esas, 2014\/13244 Karar say\u0131l\u0131 ilam\u0131 ile mahkemenin anahtar teslim tarihinin daval\u0131 taraf\u0131ndan ispatlanamad\u0131\u011f\u0131na ili\u015fkin tespiti do\u011fru g\u00f6r\u00fclmeyip anahtar teslim tarihinin 01.05.2010 tarihi kabul edilerek alacak miktar\u0131n\u0131n hesaplanmas\u0131 gerekti\u011finden bahisle h\u00fckm\u00fcn bozulmas\u0131na karar verilmi\u015ftir.<\/p>\n<p style=\"text-align: justify;\">Mahkemece, anahtar tesliminin ancak daval\u0131 kirac\u0131 taraf\u0131ndan yaz\u0131l\u0131 bir delil veya kesin bir delille kan\u0131tlanmas\u0131 gerekti\u011fi, daval\u0131n\u0131n anahtar teslimini ispatlayamad\u0131\u011f\u0131, sonradan tahliye tarihini \u00f6\u011frenmelerinin anahtar teslimi olarak yorumlanmamas\u0131 gerekti\u011fi, tacir olan daval\u0131n\u0131n d\u00f6nem sonuna kadar olan kiradan ve s\u00f6zle\u015fme serbestisi gere\u011fi cezai \u015farttan sorumlu oldu\u011fu gerek\u00e7esiyle bozmaya kar\u015f\u0131 direnme karar\u0131 verilmi\u015ftir.<\/p>\n<p style=\"text-align: justify;\">Direnme karar\u0131 s\u00fcresi i\u00e7inde daval\u0131 taraf\u0131ndan temyiz edilmi\u015f olup, Dairemizin 6763 say\u0131l\u0131 Kanun&#8217;un 45. maddesi ile 6100 say\u0131l\u0131 HMK&#8217;na eklenen ge\u00e7ici 4\/4. maddesi uyar\u0131nca \u00f6ncelikle inceleme yetkisi oldu\u011fu anla\u015f\u0131lmakla dosya incelendi, gere\u011fi konu\u015fulup d\u00fc\u015f\u00fcn\u00fcld\u00fc.<\/p>\n<p><strong>YARGITAY KARARI<\/strong><\/p>\n<p style=\"text-align: justify;\">Yarg\u0131tay 6. Hukuk Dairesince 01.12.2014 g\u00fcn, 2014\/2608 E-2014\/13244 K say\u0131l\u0131 bozma ilam\u0131nda; \u201cTaraflar aras\u0131nda d\u00fczenlenen 01.03.2009 ba\u015flang\u0131\u00e7 tarihli ve bir y\u0131l s\u00fcreli kira s\u00f6zle\u015fmesi konusunda bir uyu\u015fmazl\u0131k bulunmamaktad\u0131r. S\u00f6zle\u015fmede ayl\u0131k kira bedelinin 5.500 TL oldu\u011fu ve her ay\u0131n 5 inde \u00f6denece\u011fi kararla\u015ft\u0131r\u0131lm\u0131\u015ft\u0131r. S\u00f6zle\u015fmenin 4.maddesinde \u201cKirac\u0131 veya kiraya veren kontrat bitiminden evvel tahliye etti\u011fi veya tahliyesini istedi\u011fi takdirde bakiye kira bedelleri d\u0131\u015f\u0131nda \u00fc\u00e7 ayl\u0131k kira bedeli kadar kar\u015f\u0131l\u0131kl\u0131 olarak cezai \u015fart \u00f6demeyi ve bu cezai \u015fart\u0131n fahi\u015f olmad\u0131\u011f\u0131n\u0131 \u015fimdiden kabul ve taahh\u00fct eder. Aksi halde meydana gelen t\u00fcm zarar kira kayb\u0131 mahrumiyetinden mesul oldu\u011funu \u015fimdiden kabul<\/p>\n<p>.\/..<br \/>\n-2-<br \/>\neder\u201d h\u00fckm\u00fcne yer verilmi\u015ftir.<\/p>\n<p style=\"text-align: justify;\">Kira s\u00f6zle\u015fmesi TBK&#8217;nun 347. maddesine g\u00f6re ayn\u0131 \u015fartlarda bir y\u0131l daha uzam\u0131\u015ft\u0131r. Kira s\u00f6zle\u015fmesi uzad\u0131ktan 2 ay sonra kiralanan\u0131n daval\u0131 taraf\u0131ndan tahliye edildi\u011fi konusunda bir ihtilaf bulunmamaktad\u0131r. \u0130htilaf ta\u015f\u0131nmaz tahliye edildikten sonra anahtarlar\u0131n teslim edilip edilmedi\u011fi noktas\u0131ndad\u0131r. Taraflar kiralanan\u0131n kira s\u00f6zle\u015fmesi yenilendikten 2 ay sonra tahliye edildi\u011fi konusunda hem fikirdirler.<\/p>\n<p style=\"text-align: justify;\">Anahtar teslimine ili\u015fkin bir belge sunulmam\u0131\u015f ancak daval\u0131, davac\u0131lara anahtar teslimine ili\u015fkin yemin teklifinde bulunmu\u015f, davac\u0131lar yeminlerinde annelerinin anahtar\u0131 teslim al\u0131p almad\u0131\u011f\u0131n\u0131 bilmediklerini kendilerinin anahtar\u0131 teslim almad\u0131klar\u0131 konusunda yemin eda etmi\u015flerdir. Her ne kadar daval\u0131 taraf anahtar teslim tarihini kan\u0131tlayamam\u0131\u015f ise de; Ta\u015f\u0131nmaz\u0131n kira s\u00f6zle\u015fmesi yenilendikten 2 ay sonra yani 01.05.2010 tarihinde tahliye edildi\u011fini davac\u0131lar beyan ettiklerinden anahtar teslim tarihinin de bu tarih olarak kabul\u00fc gerekir. S\u00f6zle\u015fmenin 4. maddesinde erken tahliye halinde bakiye kira bedeli \u00f6denece\u011fi belirtilmi\u015ftir. Ancak 01.07.2012 tarihinde y\u00fcr\u00fcrl\u00fc\u011fe giren T.B.K&#8217;nun. 325. maddesinde kiralanan\u0131n s\u00f6zle\u015fme bitiminden \u00f6nce kiraya verilmesi halinde kirac\u0131n\u0131n sorumlulu\u011funun kiralanan\u0131n ayn\u0131 \u015fartlarda yeniden kiraya verilece\u011fi makul s\u00fcre i\u00e7in devam edece\u011fi kabul edilmi\u015ftir. Bu durum kar\u015f\u0131s\u0131nda daval\u0131 kirac\u0131n\u0131n anahtar\u0131n teslim tarihi olan 01.05.2010 tarihine kadar \u00f6denmeyen kira bedelinden, bu tarihten sonra da makul s\u00fcre kira bedelinden sorumlu tutulmas\u0131 gerekir. S\u00f6zle\u015fmenin 4.maddesinde erken tahliye halinde 3 ayl\u0131k kira bedelinin cezai \u015fart olarak \u00f6denece\u011fi kabul edildi\u011fine g\u00f6re taraflar kendi aralar\u0131nda makul s\u00fcreyi 3 ay olarak belirlemi\u015flerdir. Bu nedenle Mahkemece anahtar teslim tarihine kadar kira bedeline, bu tarihten sonra makul s\u00fcre olarak \u00fc\u00e7 ayl\u0131k s\u00fcreyi kabul edip \u00fc\u00e7 ayl\u0131k kira bedeline h\u00fckmetmek gerekirken yaz\u0131l\u0131 \u015fekilde davan\u0131n tamamen kabul\u00fcne karar verilmesi do\u011fru de\u011fildir.\u201d gerek\u00e7esi ile bozma karar\u0131 verilmi\u015f;<br \/>\nMahkemece \u201canahtar tesliminin ancak daval\u0131 kirac\u0131 taraf\u0131ndan yaz\u0131l\u0131 bir delil veya kesin bir delille kan\u0131tlanmas\u0131 gerekti\u011fi, davac\u0131 kiralayan\u0131n yarg\u0131laman\u0131n hi\u00e7bir safhas\u0131nda tahliyenin s\u00f6zle\u015fmenin uzamas\u0131ndan 2 ay sonra oldu\u011funa dair beyanda bulunmad\u0131\u011f\u0131, sadece dava dilek\u00e7esinde tahliyenin aradan aylar ge\u00e7tikten sonra uzama s\u00fcresi ba\u015flang\u0131c\u0131ndan 2 ay sonra oldu\u011funu \u00f6\u011frendiklerini beyan ettikleri, daval\u0131n\u0131n da anahtar teslimini ispatlayamad\u0131\u011f\u0131 ve davac\u0131ya yemin teklif etti\u011fi ve davac\u0131n\u0131n anahtar teslimi ile ilgili bilgisinin olmad\u0131\u011f\u0131na dair yemin etti\u011fi, aslonan\u0131n mecurun tahliye edildi\u011fi tarihte davac\u0131lar\u0131n durumdan haberdar olmamalar\u0131, sonradan tahliye tarihini \u00f6\u011frenmelerinin anahtar teslimi olarak yorumlanmamas\u0131 gerekti\u011fi, tacir olan daval\u0131n\u0131n d\u00f6nem sonuna kadar olan kiradan ve s\u00f6zle\u015fme serbestisi gere\u011fi cezai \u015farttan sorumlu oldu\u011fu.\u201d gerek\u00e7esi ile direnilmi\u015ftir.<br \/>\nDaval\u0131 kirac\u0131 ta\u015f\u0131nmaz\u0131n 01.05.2010 tarihinde tahliye edildi\u011fini savunmu\u015f ancak anahtar teslimini yaz\u0131l\u0131 belge ile kan\u0131tlayamam\u0131\u015ft\u0131r. Kiralanan\u0131n iade borcunun yerine getirildi\u011finin kabul edilebilmesi i\u00e7in kiralanan\u0131n anahtarlar\u0131 usul\u00fcnce kiraya verene teslim edilmelidir. Anahtar teslim edilmedik\u00e7e kiralanan\u0131n, kirac\u0131n\u0131n kullan\u0131m\u0131nda oldu\u011funun kabul\u00fc gerekir. Kirac\u0131 kiralanan ta\u015f\u0131nmaz\u0131 kullan\u0131m\u0131nda bulundurdu\u011fu s\u00fcre boyunca kira paras\u0131ndan ve ortak giderlerden sorumludur.<\/p>\n<p style=\"text-align: justify;\">.\/..<br \/>\n-3-<br \/>\nAnahtar\u0131n kiralayana teslimi, hukuki i\u015flemin i\u00e7erisinde yer alan bir maddi vak\u0131a olmakla birlikte, s\u00f6zle\u015fmenin feshine y\u00f6nelik bir hukuki sonu\u00e7 do\u011furdu\u011fundan, bunun ne \u015fekilde ispatlanaca\u011f\u0131 hususu, y\u0131ll\u0131k kira bedelinin tutar\u0131 esas al\u0131nmak suretiyle, H.M.K.nun 200. maddeleri \u00e7er\u00e7evesinde de\u011ferlendirilmelidir. E\u015f s\u00f6yleyi\u015fle, y\u0131ll\u0131k kira bedelinin tutar\u0131 senetle ispat s\u0131n\u0131r\u0131n\u0131n (HM.K. md.200\/1) \u00fczerindeyse ve kiralayan\u0131n a\u00e7\u0131k muvafakati yoksa (H.M.K. md.200\/2), bu y\u00f6n kirac\u0131 taraf\u0131ndan ancak yaz\u0131l\u0131 delille ispatlanabilir. Daval\u0131 kirac\u0131, anahtar teslimi hususunda yaz\u0131l\u0131 delil sunmam\u0131\u015f, davac\u0131ya yemin teklif etmi\u015f, davac\u0131 taraf anahtar teslimi ile ilgili bilgisinin olmad\u0131\u011f\u0131na dair yemin etmi\u015ftir. Bu durumda daval\u0131 tahliyeyi ispatlayamad\u0131\u011f\u0131ndan davac\u0131 kiraya verenin bildirdi\u011fi tarih esas al\u0131nmal\u0131d\u0131r.<br \/>\n6098 say\u0131l\u0131 T\u00fcrk Bor\u00e7lar Kanununun 6353 say\u0131l\u0131 Kanunla de\u011fi\u015fik ge\u00e7ici 2. maddesinde; \u201c Kirac\u0131n\u0131n T\u00fcrk Ticaret Kanununda tacir olarak say\u0131lan ki\u015filer ile \u00f6zel hukuk ve kamu hukuku t\u00fczel ki\u015fileri oldu\u011fu i\u015fyeri kiralar\u0131nda, 11\/1\/2011 tarihli ve 6098 say\u0131l\u0131 T\u00fcrk Bor\u00e7lar Kanununun 323, 325, 331, 340, 342, 343, 344, 346 ve 354 \u00fcnc\u00fc maddeleri 1\/7\/2012 tarihinden itibaren 8 y\u0131l s\u00fcreyle uygulanmaz. Bu halde, kira s\u00f6zle\u015fmelerinde bu maddelerde belirtilmi\u015f olan konulara ili\u015fkin olarak s\u00f6zle\u015fme serbestisi gere\u011fi kira s\u00f6zle\u015fmesi h\u00fck\u00fcmleri tatbik olunur. Kira s\u00f6zle\u015fmelerinde h\u00fck\u00fcm olmayan hallerde m\u00fclga Bor\u00e7lar Kanunu h\u00fck\u00fcmleri uygulan\u0131r.\u201d \u015eeklinde d\u00fczenleme bulunmaktad\u0131r.<\/p>\n<p style=\"text-align: justify;\">Bu d\u00fczenlemeler \u0131\u015f\u0131\u011f\u0131nda daval\u0131 kirac\u0131n\u0131n tacir oldu\u011funun dosyadaki evraklardan anla\u015f\u0131lmas\u0131 ve TBK 325. maddesinin tacirler i\u00e7in ertelenmi\u015f olmas\u0131 kar\u015f\u0131s\u0131nda s\u00f6zle\u015fme serbestisi h\u00fck\u00fcmlerine g\u00f6re taraflar\u0131n s\u00f6zle\u015fmeye uymalar\u0131n\u0131n gerekti\u011fi, daval\u0131 kirac\u0131 taraf\u0131ndan anahtar tesliminin ispatlanamad\u0131\u011f\u0131 ve dava konusu ta\u015f\u0131nmaz\u0131n 01.05.2010 tarihinde tahliye ve teslim edildi\u011fi hususunda taraflar\u0131n mutab\u0131k olmad\u0131\u011f\u0131n\u0131n anla\u015f\u0131lmas\u0131na g\u00f6re tacir olan daval\u0131n\u0131n d\u00f6nem sonuna kadar olan kiradan ve s\u00f6zle\u015fme serbestisi gere\u011fi cezai \u015farttan sorumlu oldu\u011fu bu defaki incelemeden anla\u015f\u0131lmakla, yerinde bulunmayan daval\u0131 vekilinin b\u00fct\u00fcn temyiz itirazlar\u0131n\u0131n reddi ile usul ve kanuna uygun olan h\u00fckm\u00fcn 6763 say\u0131l\u0131 Kanun&#8217;un 45. maddesi ile 6100 say\u0131l\u0131 HMK&#8217;na eklenen ge\u00e7ici 4\/4. maddesi uyar\u0131nca ONANMASINA, 4.855.00.TL bakiye temyiz harc\u0131n\u0131n temyiz edene y\u00fckletilmesine, HUMK&#8217;nun 440\/1 maddesi uyar\u0131nca karar d\u00fczeltme yolu a\u00e7\u0131k olmak \u00fczere, 18.01.2017 g\u00fcn\u00fc oybirli\u011fiyle karar verildi.<\/p>\n<p>[\/vc_column_text][\/vc_column][\/vc_row]<\/p>\n","protected":false},"excerpt":{"rendered":"<p>[vc_row][vc_column][vc_column_text]Yarg\u0131tay 3.
