Dava dosyas\u0131 i\u00e7in Tetkik Hakimi taraf\u0131ndan d\u00fczenlenen rapor dinlendikten sonra dosya incelendi, gere\u011fi konu\u015fulup d\u00fc\u015f\u00fcn\u00fcld\u00fc:<\/p>\n<p style=\"text-align: justify;\"><strong>YARGITAY KARARI<\/strong><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000080;\">Davac\u0131 \u0130steminin \u00d6zeti:<\/span> Davac\u0131 vekili, m\u00fcvekkilinin 15\/12\/2003 -31\/08\/2014 tarihleri aras\u0131nda \u00f6\u011fretmen olarak \u00e7al\u0131\u015ft\u0131\u011f\u0131n\u0131, i\u015f s\u00f6zle\u015fmesini \u00e7al\u0131\u015fma s\u00fcresi boyunca m\u00fcvekkilinin daha fazla \u00e7al\u0131\u015fmaya zorlanmas\u0131, fazla \u00e7al\u0131\u015fmalar\u0131n\u0131n, hafta sonu \u00e7al\u0131\u015fmalar\u0131n\u0131n ve e\u011fitim \u00f6dene\u011finin kar\u015f\u0131l\u0131\u011f\u0131n\u0131n da \u00f6denmemesi sebebiyle hakl\u0131 nedenle feshetti\u011fini, \u00e7al\u0131\u015ft\u0131\u011f\u0131 s\u00fcre boyunca m\u00fcvekkilinin haftan\u0131n 2 g\u00fcn\u00fc sabah 08:30-17:00 saatleri aras\u0131nda, 3 g\u00fcn\u00fc sabah 08:30-20:00-21:00 saatleri aras\u0131nda, y\u0131l\u0131n 3\/1&#8217;inde Cumartesi g\u00fcnleri sabah 10:00-15:00 saatleri aras\u0131nda \u00e7al\u0131\u015ft\u0131\u011f\u0131n\u0131, fazla \u00e7al\u0131\u015fmalar\u0131n\u0131n ve hafta sonu \u00e7al\u0131\u015fmalar\u0131n\u0131n kar\u015f\u0131l\u0131\u011f\u0131n\u0131n \u00f6denmedi\u011fini, ayr\u0131ca e\u011fitim \u00f6dene\u011finin \u00f6denmedi\u011fini bildirerek k\u0131dem tazminat\u0131 ile bahsedilen alacaklar\u0131n\u0131n h\u00fck\u00fcm alt\u0131na al\u0131nmas\u0131n\u0131 istemi\u015ftir.<\/p>\n<p><span style=\"color: #000080;\">Daval\u0131 Cevab\u0131n\u0131n \u00d6zeti:<\/span><\/p>\n<p style=\"text-align: justify;\">Daval\u0131 vekili, davac\u0131n\u0131n daval\u0131 kurulu\u015fta 10 y\u0131l\u0131 a\u015fk\u0131n s\u00fcredir \u00e7al\u0131\u015ft\u0131\u011f\u0131n\u0131, davac\u0131n\u0131n ba\u015fka bir \u00f6zel \u00f6\u011fretim kurulu\u015funda \u00e7al\u0131\u015fmak \u00fczere i\u015fyerinden ayr\u0131ld\u0131\u011f\u0131n\u0131, feshi kendisi yapan \u00f6\u011fretmenin k\u0131dem tazminat\u0131 hakk\u0131n\u0131n bulunmad\u0131\u011f\u0131n\u0131, davac\u0131n\u0131n hafta tatillerini kulland\u0131\u011f\u0131n\u0131, fazla \u00e7al\u0131\u015fma yapmad\u0131\u011f\u0131n\u0131 savunarak davan\u0131n reddine karar verilmesini talep etmi\u015ftir.<\/p>\n<p><span style=\"color: #000080;\">\u0130lk Derece Mahkemesi Karar\u0131n\u0131n \u00d6zeti:<\/span><\/p>\n<p>Mahkemece, toplanan deliller ve bilirki\u015fi raporu do\u011frultusunda davan\u0131n reddine karar verilmi\u015ftir.<\/p>\n<p><span style=\"color: #000080;\">\u0130stinaf Ba\u015fvurusu:<\/span><\/p>\n<p>\u0130lk Derece Mahkemesinin karar\u0131na kar\u015f\u0131, davac\u0131 vekili istinaf ba\u015fvurusunda bulunmu\u015ftur.<\/p>\n<p><span style=\"color: #000080;\">B\u00f6lge Adliye Mahkemesi Karar\u0131n\u0131n \u00d6zeti:<\/span><\/p>\n<p style=\"text-align: justify;\">B\u00f6lge Adliye Mahkemesince, \u0130lk Derece Mahkemesi karar\u0131n\u0131n usul ve esas y\u00f6n\u00fcnden hukuka uygun oldu\u011fu gerek\u00e7esiyle, davac\u0131n\u0131n istinaf ba\u015fvurusunun esastan reddine karar verilmi\u015ftir.<\/p>\n<p><span style=\"color: #000080;\">Temyiz Ba\u015fvurusu<\/span>:<\/p>\n<p>B\u00f6lge Adliye Mahkemesinin karar\u0131na kar\u015f\u0131 davac\u0131 vekili temyiz kanun yoluna ba\u015fvurmu\u015ftur.<\/p>\n<p><span style=\"color: #000080;\">Gerek\u00e7e<\/span>:<\/p>\n<p style=\"text-align: justify;\">1-Davac\u0131 i\u015f\u00e7inin e\u011fitim ve \u00f6\u011fretim y\u0131l\u0131na haz\u0131rl\u0131k \u00f6dene\u011fine hak kazan\u0131p kazanmad\u0131\u011f\u0131 uyu\u015fmazl\u0131k konusudur. M\u00fclga 625 say\u0131l\u0131 \u00d6zel \u00d6\u011fretim Kurumlar\u0131 Kanunu\u2019nun 33. maddesinde, \u201c\u00d6zel okullarda y\u00f6neticilik ve e\u011fitim-\u00f6\u011fretim hizmeti yapanlara, k\u0131demlerine g\u00f6re (emekliler hari\u00e7) dengi resmi okullarda \u00f6denen ayl\u0131k ile sosyal yard\u0131m kapsam\u0131ndaki ek \u00f6deme tutarlar\u0131ndan az \u00fccret verilemez.<\/p>\n<p style=\"text-align: justify;\">Sosyal yard\u0131m kapsam\u0131ndaki ek \u00f6demeler B\u00fct\u00e7e kanunlar\u0131yla resmi okul \u00f6\u011fretmen ve personeline sa\u011flanan haklara denk olarak \u00f6zel okul \u00f6\u011fretmenlerine ve personeline de \u00f6denir. Sosyal yard\u0131m kapsam\u0131ndaki ek \u00f6demelerden vergi kesilmez\u201d \u015feklinde kurala yer verilmi\u015ftir. 5580 Say\u0131l\u0131 \u00d6zel \u00d6\u011fretim Kurumlar\u0131 Kanunu\u2019nun 9. maddesinde de ayn\u0131 y\u00f6nde d\u00fczenleme bulunmaktad\u0131r. 657 Say\u0131l\u0131 Devlet Memurlar\u0131 Kanunu\u2019nun Ek 32. maddesinde ise, \u201cE\u011fitim ve \u00f6\u011fretim Hizmetleri S\u0131n\u0131f\u0131na dahil \u00f6\u011fretmen unvanl\u0131 kadrolarda g\u00f6revli olup; fiilen \u00f6\u011fretmenlik yapanlara (ilk\u00f6\u011fretim ve okul m\u00fcd\u00fcrleri ile yard\u0131mc\u0131lar\u0131, cezaevi okullar\u0131nda \u00e7al\u0131\u015fan \u00f6\u011fretmenler, y\u00f6netici, e\u011fitim uzman\u0131 ve e\u011fitim uzman yard\u0131mc\u0131lar\u0131 dahil (M\u00fclga ibare: 13\/06\/2010-5984 S.K\/mad.4) ) her \u00f6\u011fretim y\u0131l\u0131nda bir defaya mahsus olmak \u00fczere ve \u00f6\u011fretim y\u0131l\u0131n\u0131n ba\u015flad\u0131\u011f\u0131 ay i\u00e7inde Milli E\u011fitim Bakan\u0131 taraf\u0131ndan belirlenecek tarihte Cumhurba\u015fkan\u0131nca belirlenecek miktarda, \u00f6\u011fretim y\u0131l\u0131na haz\u0131rl\u0131k \u00f6dene\u011fi \u00f6denir. Bu \u00f6denek damga vergisi hari\u00e7 di\u011fer vergi ve kesintilere tabi tutulmaz\u201d h\u00fckm\u00fc mevcuttur. Her y\u0131l b\u00fct\u00e7e kanunlar\u0131yla \u00f6\u011fretim y\u0131l\u0131na haz\u0131rl\u0131k \u00f6denekleri belirlenmi\u015f ve ek cetvelde miktarlar\u0131 yay\u0131nlanm\u0131\u015ft\u0131r. \u00d6\u011fretim y\u0131l\u0131na haz\u0131rl\u0131k \u00f6dene\u011fi sosyal hak kapsam\u0131nda olup, her y\u0131l b\u00fct\u00e7e kanunlar\u0131yla miktar\u0131 belirlenen bir alacak olmakla gerek 625 say\u0131l\u0131 yasan\u0131n 33 ve gerek 5580 say\u0131l\u0131 yasan\u0131n 9. maddesi h\u00fck\u00fcmleri gere\u011fince \u00f6zel okullarda g\u00f6rev yapan \u00f6\u011fretmenlere i\u015fverenler taraf\u0131ndan \u00f6denmelidir.<\/p>\n<p style=\"text-align: justify;\">\u00d6\u011fretim y\u0131l\u0131na haz\u0131rl\u0131k \u00f6dene\u011fine hak kazanman\u0131n ba\u015fl\u0131ca ko\u015fullar\u0131; e\u011fitim\/\u00f6\u011fretim hizmetleri s\u0131n\u0131f\u0131na dahil \u00f6\u011fretmen \u00fcnvanl\u0131 kadrolarda \u00e7al\u0131\u015fmak ve fiilen \u00f6\u011fretmenlik yapmakt\u0131r.<\/p>\n<p style=\"text-align: justify;\">Somut uyu\u015fmazl\u0131kta, davac\u0131 i\u015f\u00e7inin e\u011fitim ve \u00f6\u011fretim y\u0131l\u0131na haz\u0131rl\u0131k \u00f6dene\u011fi talebi y\u00f6n\u00fcnden bilirki\u015fi raporunda \u015fartlar\u0131 olu\u015fmad\u0131\u011f\u0131 gerek\u00e7esiyle hesaplama yap\u0131lmad\u0131\u011f\u0131 belirtilmi\u015ftir. \u0130\u015fveren cevap dilek\u00e7esinde e\u011fitime haz\u0131rl\u0131k \u00f6dene\u011finin t\u00fcm e\u011fitim personeline \u00f6dendi\u011fini bildirmi\u015ftir. \u0130\u015fverence sunulan \u00f6zl\u00fck dosyas\u0131nda \u00f6demeye ili\u015fkin belgeye rastlan\u0131lmam\u0131\u015ft\u0131r. Davac\u0131n\u0131n talebinin kabul\u00fcne karar verilmesi gerekirken, eksik inceleme ile talebin reddine karar verilmesi hatal\u0131d\u0131r.<\/p>\n<p style=\"text-align: justify;\">2-\u0130\u015f\u00e7inin \u00fccretinin kanun veya s\u00f6zle\u015fme h\u00fck\u00fcmlerine g\u00f6re \u00f6denmemesi i\u015f\u00e7iye hakl\u0131 fesih imkan\u0131 verir. \u00dccretin hi\u00e7 ya da bir k\u0131sm\u0131n\u0131n \u00f6denmemi\u015f olmas\u0131 bu konuda \u00f6nemsizdir.<\/p>\n<p style=\"text-align: justify;\">\u00dccretin \u00f6denmedi\u011finden s\u00f6z edebilmek i\u00e7in i\u015f\u00e7inin yasa ya da s\u00f6zle\u015fme ile belirlenen \u00fccret \u00f6denme d\u00f6neminin gelmi\u015f olmas\u0131 ve i\u015f\u00e7inin bu \u00fccrete hak kazanm\u0131\u015f olmas\u0131 gerekir. (Yarg\u0131tay 9.HD. 18.1.2010 g\u00fcn, 2008\/ 14546 E, 2010\/ 193 K.).4857 say\u0131l\u0131 \u0130\u015f Kanunu\u2019nun 24\/II-e bendinde s\u00f6z\u00fc edilen \u00fccret, geni\u015f anlamda \u00fccret olarak de\u011ferlendirilmelidir. \u0130kramiye, primi, yakacak yard\u0131m\u0131, giyecek yard\u0131m\u0131, fazla mesai, hafta tatili, genel tatil gibi alacaklar\u0131n da \u00f6denmemesi i\u015f\u00e7iye hakl\u0131 fesih imkan\u0131 verir (Yarg\u0131tay 9.HD. 16.7.2008 g\u00fcn 2007\/ 22062 E, 2008\/ 16398 K.).Ayr\u0131ca sosyal yard\u0131m olup geni\u015f anlamda \u00fccret alaca\u011f\u0131 olan e\u011fitim ve \u00f6\u011fretime haz\u0131rl\u0131k \u00f6dene\u011finin \u00f6denmemesi davac\u0131 a\u00e7\u0131s\u0131ndan hakl\u0131 fesih nedeni olu\u015fturmaktad\u0131r. Dairemizin 2012\/33276 esas, 2013\/8117 karar say\u0131l\u0131 07.03.2013 tarihli karar\u0131nda \u00f6nceki bozma karar\u0131n\u0131n ortadan kald\u0131r\u0131lmas\u0131na karar verilerek yerel mahkemenin geni\u015f anlamda \u00fccret kavram\u0131 i\u00e7erisinde yer ald\u0131\u011f\u0131 belirtilen e\u011fitime haz\u0131rl\u0131k \u00f6dene\u011finin \u00f6denmemesinin i\u015f\u00e7i a\u00e7\u0131s\u0131ndan hakl\u0131 fesih nedeni olu\u015fturdu\u011funa ve davan\u0131n kabul\u00fcne dair h\u00fckm\u00fc onanm\u0131\u015ft\u0131r. Bu nedenle k\u0131dem tazminat\u0131 alaca\u011f\u0131n\u0131n da kabul\u00fc gerekirken reddi isabetsiz olmu\u015ftur.<\/p>\n<p style=\"text-align: justify;\"><strong>SONU\u00c7:<\/strong> Temyiz olunan \u0130lk Derece Mahkemesi karar\u0131n\u0131n ve bu karara kar\u015f\u0131 istinaf ba\u015fvurusunu esastan reddeden B\u00f6lge Adliye Mahkemesi karar\u0131n\u0131n, yukar\u0131da yaz\u0131l\u0131 sebepten BOZULARAK ORTADAN KALDIRILMASINA, dosyan\u0131n karar\u0131 veren \u0130lk Derece Mahkemesine, bozma karar\u0131n\u0131n bir \u00f6rne\u011finin ise karar\u0131 veren B\u00f6lge Adliye Mahkemesine g\u00f6nderilmesine, pe\u015fin al\u0131nan temyiz karar harc\u0131n\u0131n istek halinde ilgiliye iadesine, 19.01.2021 tarihinde oybirli\u011fiyle karar verildi.<\/p>\n<p>[\/vc_column_text][\/vc_column][\/vc_row]<\/p>\n","protected":false},"excerpt":{"rendered":"<p>[vc_row][vc_column][vc_column_text]9.
