Gayrimenkul end\u00fcstrisi ekonomik b\u00fcy\u00fcmenin en \u00f6nemli akt\u00f6rlerinden biridir.<\/p>\n<p style=\"text-align: justify;\">K\u00fcresel olarak, gayrimenkul yat\u0131r\u0131m piyasas\u0131n\u0131n, ticari ta\u015f\u0131nmazlara harcanan para a\u011f\u0131rl\u0131kta olmak \u00fczere, \u00f6zkaynak ve alacaklarla birlikte ola\u011fan\u00fcst\u00fc bir likidite hacmini ortaya koydu\u011fu belirtilmektedir. \u00a02013 y\u0131l\u0131nda elde edilen a\u015fa\u011f\u0131daki veriler de bunu ortaya koymaktad\u0131r:<\/p>\n<p style=\"text-align: justify;\">\u2013 % 21 art\u0131\u015fla 563 milyar Amerikan Dolar\u0131n\u0131 bulan y\u0131ll\u0131k sat\u0131\u015f i\u015flemleri;<\/p>\n<p style=\"text-align: justify;\">\u2013 Yakla\u015f\u0131k 200 milyar Amerikan Dolar\u0131na ula\u015fan d\u00f6rd\u00fcnc\u00fc \u00e7eyrek i\u015flem hacmi;<\/p>\n<p style=\"text-align: justify;\">\u2013 Son \u00e7eyrekte sadece 24 \u00fclkenin i\u015flem hacminin 1 milyar Amerikan Dolar\u0131n\u0131 a\u015fmas\u0131;<\/p>\n<p style=\"text-align: justify;\">\u2013 Baz\u0131 \u00fclke pazarlar\u0131nda rekor i\u015flem seviyelerinin kaydedilmesi;<\/p>\n<p style=\"text-align: justify;\">\u2013 Y\u0131ldan y\u0131la ticari ta\u015f\u0131nmaz en d\u00fc\u015f\u00fck yat\u0131r\u0131m getirisi ve piyasa de\u011fer art\u0131\u015f\u0131ndaki yukar\u0131 do\u011fru y\u0131ll\u0131k ortalama % 7.5 ivme kaydedilmesi;<\/p>\n<p style=\"text-align: justify;\">\u2013 Bir yandan otel sekt\u00f6r\u00fcnde k\u00fcresel yat\u0131r\u0131m hacminde 2013 y\u0131l\u0131nda % 40 gibi rekor oranda bir art\u0131\u015f kaydedilirken, di\u011fer yandan Avrupa\u2019da sekt\u00f6rel i\u015flem hacminde % 70 oran\u0131nda b\u00fcy\u00fcme elde edilmesi.<\/p>\n<p style=\"text-align: justify;\">2001\u2019de ya\u015fanan ekonomik kriz ve 2007\u2019de ya\u015fanan mortgage krizine ra\u011fmen, T\u00fcrkiye\u2019nin ekonomik b\u00fcy\u00fcmesinin temel lokomotiflerinden biri olan in\u015faat sekt\u00f6r\u00fc 2001-2006 y\u0131llar\u0131 aras\u0131nda ortalama % 12.7 ve 2010-2012 y\u0131llar\u0131 aras\u0131nda ortalama % 14.8 oran\u0131nda b\u00fcy\u00fcme kaydetmi\u015ftir. Ancak, sekt\u00f6rde 2013 y\u0131l\u0131nda, \u00f6nceki iki y\u0131l\u0131n verilerine oranla, d\u00fc\u015f\u00fc\u015f ya\u015fanm\u0131\u015f ve b\u00fcy\u00fcme oran\u0131 ortalama % 8.6 olmu\u015ftur. Sekt\u00f6rde ya\u015fanan bu b\u00fcy\u00fcmede, T\u00fcrkiye ekonomisinin kaydetti\u011fi b\u00fcy\u00fcmenin al\u0131m g\u00fcc\u00fcne art\u0131\u015f olarak yans\u0131mas\u0131, d\u00fc\u015fen faiz oranlar\u0131 ve T\u00fcrk Liras\u0131n\u0131n de\u011fer kazanmas\u0131 ile birlikte vatanda\u015f\u0131n di\u011fer yat\u0131r\u0131m ara\u00e7lar\u0131ndan ziyade konut yat\u0131r\u0131mlar\u0131na y\u00f6nelmesinin b\u00fcy\u00fck pay\u0131 bulunmaktad\u0131r. T\u00fcrkiye\u2019de gayrimenkule yat\u0131r\u0131m yapmak en \u00e7ok tercih edilen yat\u0131r\u0131mlardan biridir. Avrupal\u0131 \u200b\u200bmuadillerine k\u0131yasen, T\u00fcrkiye\u2019de konut fiyatlar\u0131 Do\u011fu Avrupa \u00fclkelerine g\u00f6re % 60 ile 70% aras\u0131, genel olarak Avrupa ortalamas\u0131na g\u00f6re ise % 80 ile % 90 aras\u0131 daha ucuzdur.<\/p>\n<p style=\"text-align: justify;\">Son y\u0131llarda, \u00f6zellikle kentsel d\u00f6n\u00fc\u015f\u00fcm ile birlikte, T\u00fcrkiye\u2019deki in\u015faat faaliyetlerinde gerek \u00f6zel sekt\u00f6r gerekse kamu sekt\u00f6r\u00fc aktif rol almaktad\u0131rlar. 2014 y\u0131l\u0131 itibariyle, \u00e7o\u011fu \u0130stanbul, Ankara ve \u0130zmir gibi b\u00fcy\u00fck \u015fehirlerde olmak \u00fczere, T\u00fcrkiye genelinde 2.600\u2019den fazla toplu konut projesi in\u015faat\u0131n\u0131n y\u00fcr\u00fct\u00fclmekte oldu\u011fu tahmin edilmektedir. Kamu sekt\u00f6r\u00fc aya\u011f\u0131nda TOK\u0130 (Toplu Konut \u0130daresi), Emlak GYO (Gayrimenkul Yat\u0131r\u0131m Ortakl\u0131\u011f\u0131) gibi y\u00fcklenici kurulu\u015flar\u0131n yan\u0131 s\u0131ra K\u0130BTA\u015e, TOBA\u015e gibi b\u00fcy\u00fck\u015fehir belediyelerinin i\u015ftirakleri olan y\u00fcklenici kurulu\u015flar b\u00fcy\u00fck\u015fehirlerdeki in\u015faat projelerinin y\u00fcklenilmesinde temel kurulu\u015flardand\u0131r.<\/p>\n<p style=\"text-align: justify;\">Devlet Planlama Te\u015fkilat\u0131 (DPT), 2014 y\u0131l\u0131 itibari ile T\u00fcrkiye\u2019nin y\u0131ll\u0131k yeni konut ihtiyac\u0131n\u0131n 864.000 adet civar\u0131nda oldu\u011funu \u00f6ng\u00f6rmektedir. Gen\u00e7 ve giderek \u015fehirle\u015fen n\u00fcfus, T\u00fcrkiye\u2019de gelecekteki konut talebinin kayna\u011f\u0131 olu\u015fturmaktad\u0131r. 76.7 milyon T\u00fcrkiye n\u00fcfusunun yakla\u015f\u0131k % 50\u2019si 30,1 ya\u015f\u0131n alt\u0131ndad\u0131r. Her ne kadar, \u00f6n\u00fcm\u00fczdeki y\u0131llarda \u00e7ekirdek aile say\u0131s\u0131n\u0131n artmas\u0131 ile birlikte azalaca\u011f\u0131 tahmin edilmekle birlikte, Avrupa Birli\u011fi ortalamas\u0131n\u0131n yakla\u015f\u0131k olarak iki kat\u0131 olan T\u00fcrkiye\u2019de i\u015fgal edilen konut metrekaresi de gelecekteki konut talebinin bir di\u011fer etkenidir.<\/p>\n<p style=\"text-align: justify;\">Konut al\u0131m\u0131na y\u00f6nelik yurt d\u0131\u015f\u0131ndan gelen taleplerde, T\u00fcrk konut piyasas\u0131ndaki y\u00fckseli\u015fin arkas\u0131ndaki do\u011frudan etmenlerdendir. Ekonomi Bakanl\u0131\u011f\u0131\u2019n\u0131n yay\u0131nlam\u0131\u015f oldu\u011fu istatistiklere g\u00f6re; 2013 y\u0131l\u0131nda T\u00fcrkiye 12.7 milyar Amerikan Dolar\u0131 do\u011frudan yabanc\u0131 yat\u0131r\u0131m (DYY) alm\u0131\u015f olup, bunun 300 milyon Amerikan Dolar\u0131n\u0131 gayrimenkul ve in\u015faat sekt\u00f6r\u00fcne yap\u0131lan yat\u0131r\u0131mlar olu\u015fturmu\u015ftur. Ayn\u0131 \u015fekilde, 2013 y\u0131l\u0131na kadar T\u00fcrkiye\u2019ye bu sekt\u00f6rlerde yurtd\u0131\u015f\u0131ndan gelen para 10,1 milyar Amerikan Dolar\u0131na ula\u015fm\u0131\u015f olup, bunun 3 milyar Amerikan Dolar\u0131 ile T\u00fcrkiye\u2019de gayrimenkul sat\u0131n al\u0131nm\u0131\u015ft\u0131r.<\/p>\n<p style=\"text-align: justify;\">Gayrimenkul sekt\u00f6r\u00fc, toplam GSY\u0130H\u2019\u0131n y\u00fczde 19,5\u2019unu olu\u015fturmaktad\u0131r. Bu da sekt\u00f6r bak\u0131m\u0131ndan \u00e7ok b\u00fcy\u00fck bir yat\u0131r\u0131m potansiyeli yaratmaktad\u0131r. Bir \u00f6nceki y\u0131lla kar\u015f\u0131la\u015ft\u0131r\u0131ld\u0131\u011f\u0131nda, gayrimenkul sekt\u00f6r\u00fc 2013 y\u0131l\u0131nda % 1,6 art\u0131\u015fla GSY\u0130H i\u00e7indeki pay\u0131n\u0131 % 6.0\u2019ya \u00e7\u0131karm\u0131\u015ft\u0131r.<\/p>\n<p style=\"text-align: justify;\">T\u00fcrk \u0130statistik Kurumu (T\u00dc\u0130K) taraf\u0131ndan yay\u0131nlanan istatistiklere g\u00f6re, 2013 y\u0131l\u0131nda sat\u0131lan toplam konut i\u015flem hacmi 1,1 milyon ula\u015fm\u0131\u015ft\u0131r. Bu i\u015flemlerin % 10 yabanc\u0131 yat\u0131r\u0131mc\u0131lar taraf\u0131ndan ger\u00e7ekle\u015ftirilmi\u015ftir. T\u00fcrk hukukuna g\u00f6re, yabanc\u0131lar \u015fehir, kasaba ve k\u00f6yler d\u00e2hil % 10\u2019a kadar, imarl\u0131 alanlarda m\u00fclk ve arazi sat\u0131n alabilmektedirler.<\/p>\n<p style=\"text-align: justify;\">400 milyar Amerkan Dolar\u0131 bir b\u00fct\u00e7e ile ba\u015fta deprem olmak \u00fczere do\u011fal afetlere dayanamayacak kadar k\u00f6t\u00fc durumda olan 6,5 milyon konutun y\u0131k\u0131larak yeniden in\u015fas\u0131na ili\u015fkin kentsel d\u00f6n\u00fc\u015f\u00fcm projesi de d\u00e2hil h\u00fck\u00fcmetin stratejik planlar\u0131 ve gelecek projeleri g\u00f6z \u00f6n\u00fcnde al\u0131narak sekt\u00f6r\u00fcn mevcut durumuna ili\u015fkin rakamlar ve veriler de\u011ferlendirildi\u011finde, T\u00fcrkiye\u2019de konut sekt\u00f6r\u00fcn\u00fcn yat\u0131r\u0131mc\u0131lar i\u00e7in b\u00fcy\u00fck potansiyele sahip oldu\u011funu s\u00f6ylemek m\u00fcmk\u00fcnd\u00fcr. \u00a0Konut talebindeki y\u00fckseli\u015f ve banka kredisi kullan\u0131m\u0131n\u0131n kolayla\u015fmas\u0131n\u0131n da desteklemesi ile yak\u0131n gelecekteki T\u00fcrk emlak piyasas\u0131na ili\u015fkin beklentiler pozitif y\u00f6ndedir.<\/p>\n<p style=\"text-align: justify;\"><strong>Hizmetler<\/strong><\/p>\n<p style=\"text-align: justify;\">Gayrimenkul hukuku, ta\u015f\u0131nmaz \u00fczerindeki ayni haklar, m\u00fclkiyet hakk\u0131, ipotek; gayrimenkul\u00fcn al\u0131m-sat\u0131m veya ba\u015fka bir yolla bir ba\u015fkas\u0131na devri; konut veya i\u015fyeri kiralama, kirac\u0131-kiraya veren ili\u015fkisi; kirac\u0131, alt-kirac\u0131 ve kiraya verenin hak ve y\u00fck\u00fcml\u00fcl\u00fckleri; m\u00fclkiyet haklar\u0131na ili\u015fkin ihtilaflar; emlak geli\u015ftirme; imar ve arazi kullan\u0131m\u0131; konut kredileri de d\u00e2hil \u00e7ok geni\u015f bir alan\u0131 d\u00fczenlemektedir.<\/p>\n<p style=\"text-align: justify;\">Esmeray Hukuk B\u00fcrosu olarak sahip oldu\u011fumuz geni\u015f bilgi birikimi, tecr\u00fcbe ve uzman ekip ile m\u00fcvekkillerimize gayrimenkul hukukuna ili\u015fkin her t\u00fcrl\u00fc konuda dan\u0131\u015fmanl\u0131k hizmeti sunmaktay\u0131z.
